The American Caper 2025 Ashcan Giveaway for Web (“Sweepstakes”) is sponsored by Absurd Ventures LLC (“Sponsor”), 1453 3rd Street Promenade, 4th Floor, Santa Monica, CA, 90401.
The Sweepstakes begin on Wednesday, July 23rd at 9AM PST and end Thursday, July 31st at 11:59PM PST (“Entry Period”). Sponsor’s computer is the official clock for all matters related to this Sweepstakes.
No purchase necessary to enter or win. A purchase will not increase your chances of winning. Void where prohibited or restricted by law.
1. Agreement to Official Rules
By entering or participating in the Sweepstakes, you accept and agree to be bound by these official rules (“Official Rules”).
2. Eligibility
The Sweepstakes is open only to individuals who: (a) are legal residents of Australia, Austria, Belgium, Bulgaria, Canada (excluding Quebec), Chile, Finland, France, Germany, Japan, Netherlands, New Zealand, Norway, Puerto Rico, South Africa, South Korea, Switzerland, Taiwan, Thailand, Ukraine, the United Kingdom, or the United States (including the District of Columbia); (b) at the time of entry, are at least 18 years old if residing in the United States or have reached the age of majority in their country or territory of residence; and (c) are not employees of Sponsor or any of its related companies or representatives, advertising, promotion, fulfillment or other coordinating agencies, or individuals providing services to Sponsor through an outsourcer or temporary employment agency during the Entry Period (“Agents”), or their respective immediate family members or persons living in the same household. Sponsor’s decisions are final in all matters related to the Sweepstakes.
3. To Enter
During the Entry Period, by completing the following steps and meeting the following conditions, you will get one (1) entry into the Sweepstakes:
- Visit www.absurdventures.com and sign in to your Absurd Ventures account or create an account for free;
- Submit the online entry form at www.absurdventures.com/americancaper/ashcangiveaway
Limitations on Entries:
Entries submitted on Absurdventures.com must comply with Absurdventures.com’s terms of use.
Setting up an Absurd Ventures account is free. If you do not have an Absurd Ventures account, you can go to http://absurdventures.com/register and follow the links and instructions posted to create one, subject to the applicable terms and conditions for the platform.
No other methods of entry will be accepted.
Limit one (1) entry into the Sweepstakes per person, household, Absurd Ventures account, and/or email address is permitted, regardless of the method of entry. You may not share the same username and/or email address with multiple entrants. If you attempt to obtain more than the permitted number of entries by using multiple or different email addresses, identities, or any other method, your entry will be void.
Robotic, programmed, script, macro or other automated entries (collectively “automated entries”) are not permitted. If you use any automated, programmed or like process or cheat to participate, such as a bot, such entries will be void and you may be disqualified from the Sweepstakes.
Verified or suspected cheating or attempts to cheat by a contestant (including, without limitation, by entering multiple times, submitting automated entries, or using a false identity to enter the Sweepstakes) may result in you being excluded from the Sweepstakes. Only fully completed entries are eligible.
By entering these Sweepstakes, you agree that your entry conforms to the following content restrictions (“Content Restrictions”) and that Sponsor, in its sole discretion, may remove any entry and disqualify you from the Sweepstake if Sponsor believes that your entry fails to conform to any of the following: (i) the entry must not contain material that violates or infringes another’s rights including, but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights; (ii) the entry must not disparage Sponsor (or any of its affiliates) or any other person or entity; (iii) the entry must not contain brand names or trademarks of any third-party entity; and (iv) the entry must not contain any material that is racist, offensive, pornographic, vulgar, profane, defamatory, insulting, unlawful, inappropriate, or otherwise objectionable.
For residents of France: Telecommunication and access expenses corresponding to the time of connection for participation in the Sweepstakes have been evaluated at the flat fee of 0.50 Euros per entry, and shall be reimbursed to any on-line participant requesting it in writing at Absurd Ventures – American Caper 2025 Ashcan Giveaway, 1453 3rd Street Promenade, 4th Floor, Santa Monica, CA, 90401. If you claim reimbursement for these expenses, you must provide a telephone bill demonstrating that you do not benefit from unlimited access. An incomplete request for reimbursement or one sent to the incorrect address will be invalid. You must submit reimbursement requests within two months (60 calendar days) of the prize draw closure. Reimbursement of connection costs is limited to one participation by an individual (same first name and last name, same postcode, same age). Postal fees incurred in sending supporting documentation will be reimbursed upon request, provided they are requested in writing as set forth above, and are within the limit of the lowest postal fee applicable to a letter of 20 grams or less.
For residents of Belgium and the Netherlands: Any participant who incurs telecommunication or internet costs to participate in the Sweepstakes is entitled to reimbursement. Reimbursement requests must be submitted in writing within 60 days after the close of the Sweepstakes to: Absurd Ventures Sweepstakes Reimbursement, 1453 3rd Street Promenade, 4th Floor, Santa Monica, CA 90401. Each request must include proof of cost and a written declaration that the participant does not have a flat-rate internet connection. Reimbursement will be limited to one entry per person.
4. Prizes
Five (5) of winners will receive an American Caper prize pack that includes the American Caper signed ashcan, T-shirt, and various stickers; retail value of approximately $50 (US) per winner.
Your odds of winning a prize depend upon the number of eligible entries received. All approximate retail values (“ARV”) are expressed in U.S. Dollars, Australian Dollars, and Euros. ARV of total prizes to be awarded: US $50, AUS $77, EUR € 37.
Limit one (1) prize per person. Prizes are not transferable, and no substitution of prizes for cash or other goods and services is permitted.
If for any reason an advertised prize is unavailable, Sponsor reserves the right to substitute a prize of equal or greater value. Winners are solely responsible for any applicable federal, state, provincial and local taxes on prizes. You agree to provide Sponsor with any additional information and complete any required tax or other forms relating to your receipt of a prize. Without limiting any other terms of these Official Rules, the prizes are provided as-is, without any warranty, representation or guarantee (express or implied) relative to the use or enjoyment of the prizes, including, without limitation, their quality, merchantability or fitness for a particular purpose.
5. Winner Selection, Notification, and Claiming Prizes
Sponsor or its Agent will conduct a random drawing using a computer program from all eligible entries to determine the potential winner(s) on or about Friday, August 1st at 1453 3rd Street Promenade, 4th Floor, Santa Monica, CA, 90401. All decisions regarding the selection of the potential winner(s) are final.
Potential winners will be notified on or about Friday, August 1st by email at the email address associated with their Absurd Ventures account.
Potential winners will have up to three (3) business days, from the date of the winner notification message, to respond to such notification message.
If you are selected as a potential winner, you may be required to complete and sign a Winner Declaration & Release (“Winner’s Release”) to claim your prize, which Sponsor will provide within 14 days of the first attempt to notify you. In the event that potential winner does not complete and return to Sponsor the Winner’s Release within the time period provided in the communication, Sponsor may disqualify the potential winner.
A potential winner that is a resident of Belgium, Canada, Finland, or the Netherlands must also answer a time-limited, skill-based question in order to claim a prize.
Potential winners may be required to provide a shipping address to claim a prize. If a shipping address is needed, a physical street address is required - a P.O. box is not acceptable for this purpose. Allow 6-8 weeks for delivery of a prize. If a prize is returned as undeliverable, the prize is forfeited.
If Sponsor cannot contact a potential winner, the potential winner is deemed ineligible, or a potential winner fails to sign and return any requested documents or information within the required time period, the potential winner forfeits the prize.
If a potential winner is disqualified or ineligible, or the prize is forfeited for any reason, Sponsor will award that prize to an alternate winner by random drawing from all remaining eligible entries. Only 3 alternate drawings will be held, after which Sponsor may donate the prize to a charity of Sponsor’s choice.
The potential winners will be declared winners if it is determined that they are eligible after they have returned all required documentation within the time limits to the email address provided in the notification message.
6. Release
To the extent allowable under applicable law and, in Australia, subject to and without excluding, restricting or modifying any rights or remedies to which you may be entitled as a consumer under the consumer guarantee provisions of the Australian Consumer Law in relation to the operation of the Sweepstakes and any prize won, you agree to release Sponsor and their Agents, officers, directors, and employees (collectively, the “Released Parties”) from any legal claims, including without limitation claims related to personal injury, death, or damage to or loss of property arising out of participation in the Sweepstakes, or receipt, use, or misuse of any prize), except for residents of the United Kingdom and France with respect to claims resulting from death or personal injury arising from Sponsor’s negligence and for residents of the United Kingdom with respect to claims resulting from the tort of deceit or any other liabilities that may not be excluded by law.
For residents of Austria, Germany, Switzerland: By participating in this Sweepstakes, you acknowledge: (1) In regard to a prize or any other products or services offered by Sponsor and/or its affiliates free of charge, Sponsor shall only be liable for intent and gross negligence. (2) In all other cases, Sponsor shall only be liable in cases of intent and gross negligence. In case of slight negligence, however, Sponsor is only liable for the breach of essential contractual obligations, such as delay or impossibility of performance, for which Sponsor can be held responsible. The liability in the event of breach of such an essential contractual obligation is limited to the typical contractual damage, whose occurrence could be expected by Sponsor upon conclusion of the contract based on the circumstances known at that time. “Essential contractual obligations” are those obligations whose fulfillment is essential to enable the proper implementation of the contract, and the achievement of its purpose and whose observation you as an end consumer may rely upon. The foregoing limitations of liability shall not apply in the case of explicit guarantees by Sponsor, in case of malice and injuries to life, body or health, as well as in the case of mandatory statutory regulations. Nothing in these Official Rules shall deprive you of the consumer protection rights granted to you by the laws of your residence that cannot be derogated from by agreement.
Intellectual Property Rights; Name and Likeness. “Content” means any content or materials submitted in connection with your entry to the Sweepstakes (e.g., content submitted in the web form or social media post/retweet). By submitting Content to the Sweepstakes, you hereby grant to Sponsor and a royalty-free, non-exclusive, worldwide, irrevocable license, with the right to sublicense (including through multiple tiers), to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform such Content for promotional and any other purposes in perpetuity without further consideration or payment of any type. By submitting Content to the Sweepstakes, you represent and warrant that you own all right, title and interest in and to your Content and that your Content complies with all of the Content Restrictions.
Sponsor may use Content in any media without attribution or compensation to the contestant, their successors or assigns, or any other entity.
BY ENTERING THE SWEEPSTAKES, EACH ENTRANT HEREBY UNCONDITIONALLY AND IRREVOCABLY: (I) WAIVES ANY AND ALL MORAL RIGHTS (IF ANY) WHICH THEY MAY HAVE IN CONTENTIN ACCORDANCE WITH COPYRIGHT ACT OF 1976 OR ANY SIMILAR LEGISLATION THROUGHOUT THE WORLD, PROVIDED THAT, IF UNDER ANY APPLICABLE LAW THE FOREGOING WAIVER IS NOT EFFECTIVE, EACH ENTRANT UNDERTAKES THAT IT SHALL EXERCISE SUCH RIGHTS REASONABLY AND IN A WAY THAT WILL NOT HAVE A MATERIAL ADVERSE EFFECT UPON SPONSOR, THEIR RESPECTIVE PRODUCTS OR SERVICES AND/OR THE EXERCISE BY SPONSOR OF ANY OF THEIR RIGHTS HEREUNDER; AND (II) GRANTS TO SPONSOR ALL CONSENTS REQUIRED PURSUANT TO THE COPYRIGHT ACT OF 1976 OR PURSUANT TO ANY OTHER LEGISLATION IN ANY JURISDICTION, TO ENABLE THE EXPLOITATION REFERRED TO IN THESE OFFICIAL RULES.
Except where prohibited by law, by entering this Sweepstakes and as a condition of receiving any Prize, you consent to the use of your, name, photo and/or likeness, biographical information, winning entry and statements attributed to you (if true) for advertising and promotional purposes without additional compensation.
7. Privacy and Publicity
Nothing in these Official Rules shall be deemed to exclude or restrict any of your statutory rights as a consumer. If you participate in the Sweepstakes, you consent to Sponsor’s processing your personal information social media handle(s), email address, mailing address, or Sponsor Account name (“Personal Information”) in accordance with Sponsor’s Privacy & Cookie Policy, which you can read at https://www.absurdventures.com/privacy. You also consent to Sponsor’s use of your entry, personal name, user/screen name, social media handle, likeness, photograph, voice, opinions, and/or hometown and state (“Entry Data”) for promotional purposes. Sponsor (or its Agent) has the option, but not the obligation, to use your Entry Data in any media, worldwide, without any further attribution, notification or compensation. Some jurisdictions prohibit the mandatory consents described above, so some or all of them may not apply to you.
For Residents of the European Union: The organizing entity shall be considered the data controller for the database containing Personal Information, and it provides for an appropriate data protection level. You understand that your Personal Information shall be processed for the purposes outlined below, in accordance with Sponsor’s Privacy and Cookie Policy (see https://www.absurdventures.com/privacy).
Personal Information will be used for the purposes of:
- Organizing, running, and monitoring the Sweepstakes and prize fulfillment, including, if you win a prize, publishing (i) your name on the Winner(s) List and (ii) your name and country of residence online or in any other media in connection with the Sweepstakes, as described in this Section 7 above; and
- Any additional processing activities to which you consent and/or acknowledge as applicable.
For residents of Belgium, Finland, and the Netherlands: Any publication of your name or likeness as a Sweepstakes winner will only occur if you provide explicit, freely given, informed, and unambiguous consent, and only to the extent allowed under local data protection laws. You may withdraw your consent at any time.
8. General Conditions.
Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes, (or any part of it) if fraud, technical failure, human error, or any other problem impairs its proper operation. In that event, Sponsor may hold a random drawing from among all eligible entries received up to the date of suspension for any of the prizes offered. Sponsor reserves the right to disqualify any person it finds to be in violation of these Official Rules (including tampering with the entry process or the operation of the Sweepstakes) or acting in an unsporting or disruptive manner. If you attempt to deliberately undermine the legitimate operation of the Sweepstakes, it may be a violation of criminal and/or civil law, and Sponsor reserves the right to seek damages from you to the extent permitted by law. Sponsor’s failure to enforce any term in these Official Rules shall not be a waiver of that term.
9. Limitation of Liability and Disclaimer
BY ENTERING THE SWEEPSTAKES, YOU AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW: (I) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED IN PARTICIPATING IN THE SWEEPSTAKES (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (II) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (III) PARTCIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND YOU IRREVOCABLY WAIVE ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
The Released Parties are not responsible for: (1) inaccurate information, whether caused by participants, typographical errors, or by equipment or programming associated with the Sweepstakes; (2) technical failures, including without limitation network malfunctions, interruptions, or disconnections; (3) unauthorized intervention in the entry process or the Sweepstakes; (4) technical or human error in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail or electronic communications; (6) ineligibility for any reason, including participant’s misunderstanding of the Official Rules and requirements or the entry process. If for any reason your entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, your sole remedy is another entry in the Sweepstakes, if possible. Sponsor will award no more than the stated number of prizes. If production, technical, programming or any other reasons cause more than the stated number of prizes to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes. Some jurisdictions prohibit the limitations described above, so some or all of them may not apply to you.
10. Disputes
Unless you are a resident of a member-state of the European Economic Area, South Korea, or Switzerland, all disputes, claims or controversies arising out of or relating to the Sweepstakes, including the marketing and Sweepstakes of the Sweepstakes ("Disputes"), shall be resolved exclusively by binding arbitration in the United States under the laws of the state of California, without reference to rules governing choice of laws. The only Disputes not covered by this Section are claims (i) regarding the infringement, protection or validity of your, Sponsor's or Sponsor's licensors' trade secrets or copyright, trademark or patent rights; and (ii) those brought in small claims court.
You and Sponsor shall first attempt to resolve any Dispute informally for at least 30 days before initiating arbitration. The informal negotiations commence upon receipt of written notice from one person to the other ("Notice of Dispute"). The Notice of Dispute must: (a) include the full name and contact information of the complaining party; (b) describe the nature and basis of the claim or dispute; and (c) set forth the specific relief sought. Sponsor will send its Notice of Dispute to the contact information in your entry, or other address you provide for this purpose. You will send your Notice of Dispute to: Absurd Ventures, LLC, 1453 3rd Street Promenade, 4th Floor, Santa Monica, CA, 90401, ATTENTION: Legal Department.
If you and Sponsor cannot resolve a Dispute informally, you or Sponsor may elect to have the Dispute finally and exclusively resolved by binding arbitration. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), both of which are available at the AAA website www.adr.org. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Rules and, where appropriate, limited by the AAA Consumer Rules. The arbitration may be conducted in person, through the submission of documents, by phone or online. The arbitrator shall make a decision in writing and shall provide a statement of reasons if requested by either party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. You and Sponsor may litigate in court to compel arbitration, to stay proceeding pending arbitration, or to confirm, modify, vacate or enter judgment on the award entered by the arbitrator.
YOU AND SPONSOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator shall not consolidate another person's claims with your claims and shall not preside over any type of representative or class proceeding. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
If you live in the United States, arbitration will take place at any reasonable location convenient for you. For residents outside the United States, arbitration shall be initiated in the County of Los Angeles, State of California, United States of America, and you and Sponsor agree to submit to the personal jurisdiction of that court, in order to compel arbitration, to stay proceeding pending arbitration, or to confirm, modify, vacate or enter judgment on the award entered by the arbitrator.
If the arbitrator rules in your favor on the merits of any claim you bring against Sponsor and issues you an award that is greater in monetary value than Sponsor's last written settlement offer made before Sponsor makes its final written submissions to the arbitrator, then Sponsor will: pay you 150% of your arbitration award, up to $5,000 USD (or equivalent in your national currency) over and above your arbitration award, and reimburse the arbitration fees that you paid to the AAA.
For residents of Australia: The Sweepstakes is governed by the laws of the state of California, without reference to the rules governing choice of laws, provided that you will not be deprived of your statutory rights and legal protection as a consumer granted by the laws of Australia. The court of jurisdiction shall be your country of residence.
11. Winner List
To receive the first name, last initial, and country or state of the prize winners, send a request by email to legal@absurdventures.com with the subject line “Sweepstakes Winner List – American Caper 2025 Ashcan Giveaway”. Requests must be received within 60 days of the end of the Entry Period.
Sponsor will take appropriate steps to ensure the integrity of the prize award process while respecting individual privacy rights and reserves the right to limit the scope of information provided in accordance with applicable data protection laws. If a prize winner resides in a jurisdiction that limits the public disclosure of personal information—such as under the General Data Protection Regulation (GDPR) in the European Economic Area, United Kingdom, or Switzerland—Sponsor will comply with applicable legal requirements. In such cases, Sponsor may disclose limited winner information (e.g., first name and initial, or general region) or withhold disclosure entirely where the winner has validly objected to such processing.
